Overview - Variance and Fair Hearing
Within the context of licensing and subsidy, there are instances where decisions made may be contested by the provider or parents who were affected by the decision. The following functions are contained in the application for this purpose.
Variance Request
Fair Hearing Request
The provider is notified of his right to file for a variance, review, or Fair Hearing simultaneously. The 15 day limitation for a Variance Request and the 30 day limitation to file for a Fair Hearing are running concurrently. Generally speaking, the CDD much prefers to utilize the variance and review process and seldom has an action go to a Fair Hearing.
The outcomes of each of these requests are documented in the system as they occur.
