6.2.6.1 08/21/2023 Submit a program improvement plan that 1) identifies the plan to ensure supervision is increased to include during transitions to ensure all children are accounted for, 2) identifies the placement of staff to ensure supervision is maintained on all children in their care, 3) establishes a system for staff to communicate amongst each other the whereabouts of children, 4) addresses all staff to ensure the increased supervision measures added are shared with all staff. 09/22/2023 09/22/2023 Final
Through staff interviews it was discovered that in May 2023 children were left outdoors on the playground without staff knowledge. Three (3) staff had been on the playground with the group of children. The group transitioned inside while Staff D was on break. Upon returning a few moments later to the classroom, Staff D observed Child J outdoors at the classroom window, and that the door from the classroom to the playground was closed. Staff D stated this to the other staff in the room and it was reported they were unaware that Child J was still outside. While getting Child J inside, staff noticed that Child K was also outdoors without their knowledge. This is a serious violation.
  Staff shall be able to hear all children of pre-kindergarten age and younger at all times, shall be able to see the children with a quick glance, and shall be able to physically respond immediately.

A review of staff schedules and children's attendance on 7/25/23 found that Staff A was in the Purple Classroom from 8:15-12:00, but documents also show that Staff A signed children in prior to 8:15 and signed children out after 12:00 from that group which indicates a discrepency of when Staff A was with that group of children. On 7/25/23, Staff E shows they left at 4;25 both on Brightwheel and the paper system, yet the last child from that group was signed out at 4:43 by Staff F who had not been in that room since 8:00 am. This rule was previously cited on 2/27/23.
  Staffing Schedule: A licensee shall maintain a written record of the daily schedule for at least 365 days of all staff including exact days and hours worked and the group of children to whom they are assigned.

3.2.5 08/21/2023 Ensure the Division is notified of all self-reported violations as required by this rule. Submit a program improvement plan that 1) ensures accurate information is obtained for any instance that a situation occurs that meets the definition of a self-reported violation, to include documenting each staff's involvement, the details as reported by each staff, and how management was made aware of the situation, 2) identifies the person responsible for ensuring the report is made to the Division and, 3) states what the follow measures were to ensure the situation does not continue. 09/22/2023 09/22/2023 Final
Through staff interviews it was discovered that in May 2023 two (2) children were left on the playground without staff knowledge. This situation was reported to management but not reported to the Division as required. On 8/16/23, two (2) groups of children were on the playground when one (1) staff left without someone covering for them resulting in the other staff being over ratio. This issue was reported to management but it was not reported to the Division as required.
  Self-reported violations: If an incident or situation occurs in a CBCCPP while children are present that could be considered a serious violation as defined in the rule 2.2.50 of these regulations, the licensee has a responsibility to self-report this to the Division within twenty-four (24) hours of the incident. A complete report will include a description of the incident, what the licensee has done to verify the particulars of what occurred, and how the licensee has taken corrective action to ensure the safety and well-being of children and to prevent a future serious violation. If such a report is received in a timely manner from a licensee with a history of consistent regulatory compliance, no child has been seriously injured or harmed as a result of the incident or situation, and the licensee has taken prompt and appropriate corrective action; the Division may, on a case by case basis and at the Division's discretion, elect to issue a warning, rather than a violation related to that incident or situation.

6.2.1.3 08/21/2023 Submit a program improvement plan that identifies 1) a system of communication between staff when leaving a group that ensures appropriate staffing remains meeting ratio requirements, 2) a system to account for how many staff are required at all times based on the ages of children and the number of children within that particular group, and 3) a system to notify management in the moment when ratios are not met, and 4) a system to review with all staff shifts in practice or reminders related to maintaining ratios and maximum group size. 09/22/2023 09/22/2023 Final
On 8/16/23 Staff C went on break leaving their group of seven (7) children on the playground without staff coverage. Staff A was on the playground with their own group of six (6) children and observed Staff C go inside the building at 10:59 and no staff returned to that group of children until 11:07, leaving Staff A on the playground with thirteen (13) children, exceeding the 1:10 ratio required based on the ages of children in the group. This is a serious violation.
  The program director shall ensure that the number of staff present meets requirements described in the chart below for ages of children, maximum group size, and staff/child ratios at any time of day.

6.2.6.2 08/21/2023 Submit a program improvement plan that 1) reviews the outdoor time for all groups to ensure a system is in place for staff to identify which children are in their group when other groups are present, 2) develops a plan to ensure children leaving the assigned space are not able to without staff accompanying, 3) identifies the placement of staff to ensure supervision is maintained on all children in their care, 4) establishes a system for staff to communicate amongst each other the whereabouts of children, to include times that children need to leave the group and identifying which staff is responsible for any child leaving the group and for the remaining children, and 5) documents reviewing supervision requirements and systems with all staff. 09/22/2023 09/22/2023 Final
On 8/9/2023 two (2) children were located inside the building without the staff assigned to that group knowing the whereabouts of those children. Staff report having told the children to request assistance from another staff member on wanting to go inside, while the other staff member states the children never sought their assistance. While a staff member from another group went inside the building after noticing the children had entered, they discovered a third child in the building unattended by staff. The program notified the Division of this incident on 8/10/2023.
  Staff shall know the whereabouts and activities of all school age children at all times and shall be able to physically respond immediately.
