Factual Basis for Violation
:
Video footage from 12/09/2019, shows a staff person using inappropriate guidance that did not encourage a child's self-control, self-direction or cooperation. The staff person placed her hand around the child's upper arm as he walking past him. As the child next to the staff person, she is seen pulling him towards her body two times and the child is turned to face her. The staff person placed both of her hands on the plastic ball that the child was holding in his hands. The staff person raises her arms lifting the ball above the child's head. The child was still holding onto the ball at the time. The child's was pulled up into the air less than 1 inch off the ground. His hands come off the ball and he falls backwards to the floor. The child lands upon his back and hits his head upon the uncarpeted floor. The staff person puts one hand upon the child's upper arm and pulls the lying child up to a standing position. Per the staff person's statement about the incident, the staff person was addressing the child not listening to her request that toys be put away and that he was being unsafe with the ball.
Regulation 6.2.7.3:
Staff shall use positive methods of guidance and behavior management that encourage self-control, self-direction, self-esteem and cooperation.
